December 2006 Minutes

DECEMBER 13, 2006 - REGULAR BOARD MONTHLY MEETING MINUTES

At 6:00 pm, Al Smith, President of the Board, called the meeting to order.

Board Members Present: Al Smith, Dave DiBerardino, Peter Carey, Don Montgomery, Erin Dellaporta

Approval of P.O.A. Board Meeting Minutes from Previous Regular P.O.A. Board Meeting: Copies of the November 8, 2006, Regular Board Meeting Minutes were presented to the Board Members for review prior to the meeting. Dave made a motion to approve the November 8th meeting minutes. Don seconded the motion. All Board Members voted in favor of the motion.

Financial Report: Financial reports presented to the Board included the Monthly Budget Summary; Cash on Hand as of November 30, 2006; and additional detailed reports of cash in the bank for the Money Market, Operating, Hockey Rink, and Performance Deposit Accounts for the month of November. A summary of CD accounts was included in the financial package, as well as Bank Reconciliation statements for the month of November. After reviewing the presented materials, Erin made a motion to approve the financial report as presented. Dave seconded the motion. All Board Members present voted to approve the financial report.

Unscheduled Property Owners Comments: No property-owner comments were made during this allotted time period. Chris announced the upcoming Rural Transportation Authority meeting on Friday, December 15th, at the Crested Butte Town Hall, 8:45 am. It is a good idea to go to these meetings. The RTA has started running busses on Hwy. 135, but there are no bus stop signs. Chris feels there should be shelters and pull over lanes. Gary Garland, who was present at the meeting, said he thinks the RTA needs public input; everyone needs to show up and keep speaking up. The bus service is ours to lose.

New/Continued Business:
Informal Discussion with Gary Garland to consider building a fully-enclosed hockey rink in CB South's Red Mountain Park Gary Garland led this discussion. Bob Piccaro from the Town of CB was also present. Building an indoor ice rink has been under discussion for a long time in the Town of Crested Butte. The Town and the East River Skating Association have agreed to hire an architect to come in to Crested Butte for a design study. The Town has political issues and a wetlands situation, but Gary will fully support the upcoming Town efforts. However, due to several possible pit-falls to building the enclosed rink in Crested Butte, Gary has come to CB South about a backup plan. He wants to see an enclosed rink's construction begin next summer. The proposed location for a rink in CB South is in our park area where the tennis court is currently located. The tennis court would be relocated. The building would be 270' X 120', housing an NHL-size rink. It would be no higher than 28' or 14' tall on the eves. There would be space to house the Zamboni machine. Gary did not ask for any special design consideration from the Board and pointed out that the building would not be as tall as the existing fire station. The project would be completed with in-kind donations, like a barn-raising. Gary and his partner(s) will put in one million dollars; he is doing all of this for the youth hockey program. The facility can be upgraded with donations down the road as they come in. The thought is that a rink could be a potential profit center. There would be the option to do a hockey camp (or camps) in the summer. If the Town doesn't work out, Gary has to make a decision by February 1, 2007. He offered to come to another meeting, if further discussion is desired. Chris has talked with our attorney. The Board can make a decision on the use of this park land without an owner-wide vote. The Board wants to make sure that the operation of the enclosed rink can pay for itself. In a straw poll, all Board Members showed interest in having the enclosed rink in CB South. They would however need to make sure there is a Master Plan for the entire park area before construction could begin.

Crested Butte Nordic Council Service Grant Request
Keith Bauer of the Nordic Council was present at the meeting because he had heard that CB South was talking about trying to groom a ski trail or two. He explained the mission of the Nordic Council, which is a non-profit organization set up to serve the residents of Gunnison County. Keith reported that the Land Trust wants to groom a Nordic trail on the Niccoli Parcel, which the Land Trust is purchasing. (They are purchasing the top 35 acres along Highway 135.) It would have to be a paid trail, which works on the honor system. There would also be some ski patrollers. Passes for the Nordic trails cost $120 in early season. The Town of Crested Butte contributed $20,000 for trails last year. The County gave $10,000. Mt. Crested Butte gave $5,000. Skyland contributed $3,000, and River Bend gave $1,500. The question was raised as to whether the Nordic Council could provide a trail for CB South and whether it is something CB South would be willing to kick in for. Following this informational session, the Board agreed that CB South will not go forward and do anything regarding grooming a trail without talking to the Nordic Council first.

Adoption of the 2007 P.O.A. Budget
The proposed budget for 2007 was presented to the Board. Following a brief discussion, Pete made a motion to approve the budget as presented. Don seconded the motion. All Board Members voted in favor of the motion.

Rutherford Shed Discussion
The shed at 543 Teocalli Road was placed on the property contrary to the location directed by the P.O.A. Additionally, the shed should have been painted to match the house, but the paint turned out to be a different color. The owner is asking for a permission not to have to move the shed or repaint it until Spring. The Board agreed that they are reluctant to grant a variance to leave the shed in its current position, and the changes will have to be made. However, the Board has no problem with leaving it until the springtime weather permits the moving and painting. The owners will have to talk to the Board before moving the shed in the Spring to avoid this same situation again. Al suggested that the discussion should be revisited no later than June of 2007.

River Rim's Joint Use Agreement Amendment Discussion
In 1993, a cooperative agreement was signed between the CB South Property Owners Association and the developer of River Rim. The agreement allowed the property owners in River Rim to access their lots via the CB South roads, and allowed property owners in CB South to access River Rim's open space. The agreement also allowed River Rim owners to use the parks and common areas of CB South. River Rim property owners became Associate Members with this agreement, which means, according to our bylaws, they are to pay CB South P.O.A. annual dues, but they are not allowed to vote on CB South governance issues. Angela Reeves and Gordon Reeves represent the River Rim Property Owners Association. They are asking that the old agreement be modified so that River Rim property owners would be able to vote. The developer who originally made the agreement is now out of the picture. River Rim does not want to be absorbed by or merged into CB South, mainly because the design guidelines of River Rim and CB South are different. Gordon suggested a policy could be drafted and incorporated into a modified agreement that, in case of a difference, the stricter covenant or design guideline would prevail. It was decided that the CB South Manager will read through the agreement and see what can be done.

Due to time restraints, the audit was not discussed. It will be put on a later agenda.
